One of the main excuses we get from people who believe they can’t start a Group Home in the next 30 – 60 days usually goes something like this:

“That won’t work in my area. In the state of (Blank) you are required to (Blank) before you can open a Group Home.”

That second blank is usually filled in with “Get a Group Home License” which will then send them down a very time consuming, costly, and confusing process researching how to become a licensed facility.

Look, if you have the money, time, and desire to become licensed there are some advantages, but it is not REQUIRED.

Follow the same rules and regulations that EVERYONE ELSE needs to follow…and your area can’t regulate your home just because you are housing seniors, males, females, former inmates, veterans, all of the above, or any other segment of the population. If they do…or try to…they would be in direct violation of the FEDERAL Fair Housing Act!

So what are some of these local Group Home laws you need to follow and where do you find them?

Every city, county and state is going to have different “property code” where they regulate everything down to the length of the grass you can have! You can usually find the full code by searching the following terms:

“(BLANK) County Property Code” or something similar

There are some rules that could hinder your business or limit the amount of income you can make, so we definitely recommend finding these out!

1) How many tenants per square feet?
This will vary depending on location, but in general you should be able to get at least 2 people per bedroom as long as it is not a very small house. Check out THIS ARTICLE for more details.
2) Are there any maximum occupancy laws?
Some areas like SAN ANTONIO do not allow more than 6 unrelated occupants to live in a single family home. If you are in an area like this, it might make sense to focus on Three-Bedroom homes.
3) Do they limit outsourced care?
PENNSYLVANIA is the only place I’m aware of with laws like this, but you cannot used outsourced licensed care for more than three occupants in a home. So the obvious answer to this is limit the amount of tenants that need licensed care! You can focus on functioning adults to avoid this altogether.
4) Is there any additional “Registration” required?
In places like PHOENIX and possibly LOUISVILLE (not sure of the outcome on this one) they want “boarding homes” to be “registered”. This involves minimal paperwork, small fees, and they struggle with enforcement since this can be contested with Federal law.

Now 3 and 4 could probably be contested under the Fair Housing Act, but they are not extremely restrictive.

The main point is….

A GROUP HOME LICENSE IS NOT REQUIRED!

Follow the same rules any other housing provider needs to follow (AKA Landlord), do not perform care that requires a license you don’t have, don’t advertise that you do if you don’t, and keep up with your home just like anybody else is required to!

We recently highlighted an article that disparaged unlicensed Group Homes. In it, they wrote of one owner in particular that overcrowded his homes, encouraged his tenants not to take their prescribed medication and took advantage of his tenants.

There was no mention of the countless other Sober Living Homes in the area that provided great service and helped the community!

Today I want to highlight an article showing the positive, life changing effects that a Group Home can have on it’s tenants. Probably some of the reasons that brought YOU to us in the first place!

In addition to the Grants, Donations, and revenue from their banquets, the Oakwood home also charges each tenant $80/week.

They do not release how much they receive from Grants, Charity etc. but my guess is that is much more than the revenue charged to their guests.

The home has been open for 45 years, has a non-profit set up, and most likely has a ton of connections in the area.

Find Out What License You Need To Start a Sober Living Group Home

The above article writes about Sober Living Home operators in a negative light…the angle that most press takes unfortunately…but it highlights some of the issues that we write about a lot.

There will ALWAYS be some back and forth between businesses and the Government. In every industry…not just housing. The Government is always going to want more power, regulations and the revenue that comes with that…and businesses are going to want more freedom. Group Homes are no different.

Is there an argument to require every single person that wants to rent out rooms to people to have a license? Sure!

Is requiring every home to be “licensed” going to guarantee a living situation where nothing goes wrong or everybody that gets involved provides tremendous service?

I could go pick awful stories about LICENSED homes all day.

No matter where you stand on the issue of whether or not Group Homes should be licensed or not, it is important that you receive accurate information!

“Operators face few legal requirements, which allows pretty much anyone to open up a sober home.”
“It’s difficult to regulate sober homes, and that’s partly because of existing federal antidiscrimination rules.”
“Residents of these houses, as a group of disabled people living together, are protected by the Americans with Disabilities Act and the Fair Housing Act.”

Government Programs To House Veterans in Your Group Home

Another program is the HUD-VASH program..
“Veterans are using 138 of the 190 vouchers. Twenty-four veterans in Boise have vouchers, but can’t find apartments. The veterans are living in shelters, on the streets, or “couch surfing,” staying with friends until something opens up, said Anna Johnson-Whitehead, health care for homeless veterans program manager at the Boise Veterans Affairs Medical Center. Twenty-eight more “open” vouchers are available for veterans to use.”

“The home is owned and operated Amy Bacashihua, a woman who ran group homes for the elderly most of her life. She currently has ten tenants and beds at a base rate of $1,000 a month – but has a policy of leniency motivated by her Christian faith.

She’s giving the Valentinos a significant break on the rent. LA Family Housing are giving them supplementary assistance for a couple months until the couple can save money. She also accepts rent by way of Social Security or disability insurance.

A welcome sheet and mission statement for the home calls it a “collaborative housing program” and “a never-give-up experiment to reduce homelessness among a diverse group of people in the area who are unable to afford housing by themselves.”

Tenants do not sign a lease but must have some form of monthly income, stick to two to a room and “follow a set of rules, including doing chores and attending counseling sessions.” Bacashihua, who lives at the home, said she sometimes struggles to manage behavior issues related to substance abuse.

“I do it because I have hope that they can get out of this situation,” she said from outside the home Tuesday, suggesting the model is part of a growing network of shared low-income housing serving formerly homeless people.”

If you’ve exhausted your own network of family, friends, and friends of friends that might have a vacant rental property for you to use than the next option is cold marketing to landlords. The good news is that there are hundreds if not thousands of people in your area that have problems that YOU can solve with a Group Home…

Let’s take a look at this ad, and I will highlight some keywords that make this the perfect prospect.

“House is not in best shape. Vinyl floors and laminate in poor condition. There is clear evidence of foundation problems. Landlord will not fix floors. House has nice back yard. Garage was converted to extra room. House is priced cheaply due to the lack of remodeling and its poor condition. On the positive side. The house is 4 bedroom with a extra room and has 2 bathrooms one with tub and the other with a tub.”

Do you think this homeowner has traditional renters blowing up his phone day and night to get into this gem? NO! He is MUCH MORE likely to negotiate on subletting..if they even have a policy like that. That’s really all you need. But the underlined sections are PROBLEMS. What do we always say? Want to make a lot of money? Figure out how to solve problems! These are some questions I would ask this homeowner to get an even better deal than is already presented…

Would you consider a rent to own situation?
Would you consider a discounted cash offer in return for a quick, “as-is” sale?
Would you consider rent credits if I were to make repairs to the home?
Would you consider a lower rental amount if I agreed to manage maintenance for this home?
I have a business that could generate approx $6000 per month from this home. I would do all of the marketing and managing. Would you be open to working out an agreement that might work out better for you than the asking price?
