You definitely CAN become a licensed Group Home…and there are many advantages and disadvantages to both business models.

We’ve been in group home business for almost 20 years, his homes are not licensed facilities, and we don’t employ any nurses or anything like that. The main reason for going this route is that becoming licensed can be extremely costly, time consuming, and CONFUSING!

“HOW DOES THAT WORK??? The lady at the county told me I need to fill out all this paperwork and take all these classes???”

This is a typical response.


You need to follow all local rules and regulations that are applied to ALL HOUSING PROVIDERS. They are going to regulate everything down to how high your grass can grow in most municipalities but they can’t deploy specific regulations to specific groups of people…like group home owners, veterans, transitioning homeless or ex-prisoners, seniors, people trying to get sober, etc. etc. This is in direct violation of THE FEDERAL FAIR HOUSING ACT as the “Understanding the Business Model” and the “Fair Housing” section in OUR FREE 10 PART COURSE.

What are some examples of rules and regulations applied to EVERYONE that can affect your business?

Another, is that some areas have maximum occupancy laws. Not all of them but some…particularly “college” towns. They will limit the amount of “unrelated occupants” living in one home. Typically, in areas that DO do this, the number is 6…but some cities, like Tempe, AZ are VERY restrictive and limit this to 3.

That sounds super restrictive right?

Because it is!!!


In fact, many Group Homes have been able to challenge these types of laws for discrimination and WON.

“Oxford House” is a national Sober Living organization and they challenge these rules often.
HERE in North Carolina and in Indiana, HERE for example.
Here is their legal case from the article above…
“Since residents are considered ‘disabled people’ under county ordinances they are considered a protected class under the Fair Housing Act.
“As members of a protected class under the FHA, Oxford Houses are protected against discriminatory zoning practices. As such, the issue of whether an Oxford House is in violation of local zoning ordinances is not relevant to the question of federal law,” the application states. There are several court cases referenced in the application citing precedence for this argument.”

Another common objection we get is that this only works in Texas and Texas is the wild wild west still!

There’s always going to be conflicts between business and government. Government will want more control, more regulation, more fees, more POWER and local businesses typically want the opposite.

Check out your local rules by either going to your county website or contacting them and if you ARE in one of those areas with stricter regulations, use your own discretion. If you want to start a Group Home for veterans you have a couple options. You can deal with the VA directly but they will have their own rules and regulations that vary with location. For example:

“The HUD-VASH vouchers offer to pay for market-rate housing for veterans, but they also require case management to help provide homeless veterans with services such as mental health counseling and addiction treatment should they need them.”

What we recommend, is casting a WIDE NET with your marketing! Matter of fact, many vet’s do not qualify for this program but still receive assistance for their housing! For Example:

“If a veteran was not eligible for the Housing and Urban Development-Veteran’s Affairs Supportive Housing program, or HUD-VASH, he or she was referred to a non-veteran’s housing service such as the OC Housing Authority”
To help homeless veterans, Orange County announced in July the Marching Home strategy aiming to end veteran homelessness by December 2020, after securing $2.9 million in state funding.”
He used to receive disability checks for manic depressive disorder, which hindered his ability to work.”

Is the majority of their revenue from Hamburgers, fries, milkshakes…does the majority of their profits come from Happy Meals?

McDonald’s does not make their money from Burgers…or anything food related.

McDonald’s owns the building/land and THEN LEASES the building to their “Franchisees” . This is how the actual McDonald’s corporation makes most of their profits! They are NOT in the food business!

Of that $18.2 billion generated by company-operated stores in 2014, the corporation keeps just $2.9 billion. Of the $9.2 billion coming from franchisees, the corporation keeps $7.6 billion.
In 2014 McDonald’s made 4.75 billion dollars in net income (sweet profit dollars). Essentially we could say that 82% of every dollar in profit is generated by a franchisee. That’s an intense statement about a “burger company”.”

Your Local Rules Regarding a Group Home License

One of the main excuses we get from people who believe they can’t start a Group Home in the next 30 – 60 days usually goes something like this:

“That won’t work in my area. In the state of (Blank) you are required to (Blank) before you can open a Group Home.”

That second blank is usually filled in with “Get a Group Home License” which will then send them down a very time consuming, costly, and confusing process researching how to become a licensed facility.

Look, if you have the money, time, and desire to become licensed there are some advantages, but it is not REQUIRED.

Follow the same rules and regulations that EVERYONE ELSE needs to follow…and your area can’t regulate your home just because you are housing seniors, males, females, former inmates, veterans, all of the above, or any other segment of the population. If they do…or try to…they would be in direct violation of the FEDERAL Fair Housing Act!

So what are some of these local Group Home laws you need to follow and where do you find them?

Every city, county and state is going to have different “property code” where they regulate everything down to the length of the grass you can have! You can usually find the full code by searching the following terms:

“(BLANK) County Property Code” or something similar

There are some rules that could hinder your business or limit the amount of income you can make, so we definitely recommend finding these out!

1) How many tenants per square feet?
This will vary depending on location, but in general you should be able to get at least 2 people per bedroom as long as it is not a very small house. Check out THIS ARTICLE for more details.
2) Are there any maximum occupancy laws?
Some areas like SAN ANTONIO do not allow more than 6 unrelated occupants to live in a single family home. If you are in an area like this, it might make sense to focus on Three-Bedroom homes.
3) Do they limit outsourced care?
PENNSYLVANIA is the only place I’m aware of with laws like this, but you cannot used outsourced licensed care for more than three occupants in a home. So the obvious answer to this is limit the amount of tenants that need licensed care! You can focus on functioning adults to avoid this altogether.
4) Is there any additional “Registration” required?
In places like PHOENIX and possibly LOUISVILLE (not sure of the outcome on this one) they want “boarding homes” to be “registered”. This involves minimal paperwork, small fees, and they struggle with enforcement since this can be contested with Federal law.

Now 3 and 4 could probably be contested under the Fair Housing Act, but they are not extremely restrictive.

The main point is….

A GROUP HOME LICENSE IS NOT REQUIRED!

Follow the same rules any other housing provider needs to follow (AKA Landlord), do not perform care that requires a license you don’t have, don’t advertise that you do if you don’t, and keep up with your home just like anybody else is required to!

We recently highlighted an article that disparaged unlicensed Group Homes. In it, they wrote of one owner in particular that overcrowded his homes, encouraged his tenants not to take their prescribed medication and took advantage of his tenants.

There was no mention of the countless other Sober Living Homes in the area that provided great service and helped the community!

Today I want to highlight an article showing the positive, life changing effects that a Group Home can have on it’s tenants. Probably some of the reasons that brought YOU to us in the first place!

In addition to the Grants, Donations, and revenue from their banquets, the Oakwood home also charges each tenant $80/week.

They do not release how much they receive from Grants, Charity etc. but my guess is that is much more than the revenue charged to their guests.

The home has been open for 45 years, has a non-profit set up, and most likely has a ton of connections in the area.

Find Out What License You Need To Start a Sober Living Group Home

THERE ISN’T A LICENSE REQUIRED TO START A GROUP HOME!

 

The above article writes about Sober Living Home operators in a negative light…the angle that most press takes unfortunately…but it highlights some of the issues that we write about a lot.

There will ALWAYS be some back and forth between businesses and the Government. In every industry…not just housing. The Government is always going to want more power, regulations and the revenue that comes with that…and businesses are going to want more freedom. Group Homes are no different.

Is there an argument to require every single person that wants to rent out rooms to people to have a license? Sure!

To add to that argument, “Group Homes” could be dealing with people trying to get off drugs, transitioning out of homelessness, coming out of prison….can there be some issues??

Of Course!!

To counter that…

There can be with apartments too...And licensed homes…And hospitals…and on and on

The articles take a greedy Group Home owner that puts his residents in overcrowded homes, living in squalor, not providing the care that was advertised and getting rich while doing it.

Guess what?

THIS IS ILLEGAL ALREADY. And should be! Any one that doesn’t keep their property up to code or advertises falsely deserves to be shut down!

Is requiring every home to be “licensed” going to guarantee a living situation where nothing goes wrong or everybody that gets involved provides tremendous service?

I could go pick awful stories about LICENSED homes all day.

No matter where you stand on the issue of whether or not Group Homes should be licensed or not, it is important that you receive accurate information!

We get so many people that think a license is REQUIRED. IT IS NOT. Take a look at some of these quotes from an editor that is NOT a fan of unlicensed Group Homes….

Government Programs To House Veterans in Your Group Home

Another program is the HUD-VASH program..
“Veterans are using 138 of the 190 vouchers. Twenty-four veterans in Boise have vouchers, but can’t find apartments. The veterans are living in shelters, on the streets, or “couch surfing,” staying with friends until something opens up, said Anna Johnson-Whitehead, health care for homeless veterans program manager at the Boise Veterans Affairs Medical Center. Twenty-eight more “open” vouchers are available for veterans to use.”
